Position Overview This Labor Conciliator position is located Downtown Springfield, IL Office located in Sangamon County. The Labor Conciliator will assist the Equal Pay Act Section in the Department of Labor. Equal Pay Act Section is responsible for assisting people recover unpaid wages as required by the various laws enforced by the Department. Minimum Qualifications Requires knowledge, skill and mental development equivalent to completion of four years of college, preferably supplemented by courses in labor law and industrial relations. Requires three years of professional experience with Illinois Labor Laws and conducting audits. Essential Functions Independently researches, investigates, and settles complaints and alleged violations of Equal Pay Act applying relevant laws, regulations, policies and/or precedents to reach conclusions. Reviews and performs expert level analyses of records to determine cause or jurisdictional applicability of the Illinois Equal Pay Act and other programs. Reviews and analyzes payroll records and other records and evidence of employees to ensure that employers are providing equal pay pursuant to the Act. Investigates and audits employers' records for wages and benefit payments, which are due to employees under the Equal Pay Act and other laws. Interviews claimants, employers, and/or other affected parties to obtain information about disputed issues. Facilitates communication between disputants to guide parties toward mutual agreement. Determines the extent and timeline of periods of noncompliance with the law. Determines proper enforcement of labor claims. Documents interviews and notes discrepancies in records and other evidence. Conducts and documents audits, maintains accurate progress notes, collects evidence, drafts related documents, logs verbal and written communication. Lifts files and record boxes weighing 25 lbs. – 50 lbs. Schedules and conducts resolution conferences, corrective action conferences, conciliation meetings, and settlement conferences; participates in formal hearings providing expert testimony. Offers interpretation of analysis and research for assessment of work processes and improvement or updating of practices and policies. Monitors compliance with corrective action plans for labor claims and timeliness of payments. Develops and prepares documents and reports regarding analyses, findings and recommendations related to investigations conducted under the Illinois Equal Pay Act for use at all phases of investigation and enforcement process. Cites and references applicable laws, rules and regulations in documents, reports and correspondence as needed. Responds to inquiries in writing and through telephone communication related to the Illinois Equal Pay Act. Researches and develops a variety of information related to the Illinois Equal Pay Act and any other laws related to equal pay benefits and presents this information to employers, labor organizations, and the public. Testifies and serves as an expert witness in administrative hearings and court proceedings regarding penalties, fines and potential criminal charges. Researches case law and administrative rules to determine compliance of willful violations. Draft subpoenas for review by managers in the Equal Pay unit who rely on Legal department to ensure compliance with applicable laws and rules. Prepares settlement agreements. If the parties do not reach a settlement agreement, prepare cases for referral to IDOL Hearings or the Office of the Attorney General. Utilizes a laptop computer to write complete, accurate, and document inspection reports to be used in determining the need for possible enforcement action. Receives, evaluates, and responds to written, telephone and in person inquiries. Reviews and enters investigation/case progress into a case management system. Performs other duties as required or assigned which are reasonably within the scope of the duties enumerated above. Preferred Qualifications Two (2) years of experience working with Labor Law rules, Acts, and regulations. Two (2) years of professional experience in labor conciliation and/or labor mediation. Two (2) years of experience preparing comprehensive reports with recommendations. One (1) year of experience conducting investigations and conducting hearing and conferences. One (1) year of experience processing and storing confidential documents. Conditions of Employment Overtime is a condition of employment, and you may be requested or required/mandated to work overtime including scheduled, unscheduled, or last-minute overtime. This requires the ability to work evenings and weekends. Requires the ability to carry and use a state-issued phone and laptop. Requires ability to travel in the performance of duties, with overnight stays as appropriate. This position is considered medium work as defined by the U.S. Department of Labor (20CFR 404.1567(c)). Medium work involves lifting no more than 50 pounds at a time with frequent lifting or carrying of objects weighing up to 25 pounds.
